Nullification is Constitutional

The near-showdown in Texas did not break any new ground in the nullification debate. The Texas House of Representatives passed a law that made the touching of genitals or breasts by TSA personnel illegal and punishable by fines and imprisonment. The federal government responded by citing the Supremacy Clause of the U.S. Constitution, together with a threat to cancel all air travel to and from Texas if the law were passed by the Senate and signed by the governor. The Texas Senate backed down. The crisis was averted – for the moment.

For most, attention was probably focused on the threat to close down air travel. Indeed, this would have been a huge crisis, with economic ramifications far beyond Texas. However, the more important issue here is the constitutional one. The federal government states as if it were fact that under the Supremacy Clause “Texas has no authority to regulate federal agents and employees in the performance of their federal duties or to pass a statute that conflicts with federal law.” Does the Supremacy Clause really say this? Let’s take a look. It says,

“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

Idaho: Gov. Butch Otter has vetoed legislative effort to “nullify” the federal health care reform law

BOISE – Idaho Gov. Butch Otter has vetoed HB 298, the final version of a much-debated legislative effort to “nullify” the federal health care reform law.

The bill declared that Idaho wouldn’t comply with discretionary provisions of the law for one year, made various declarations, and prohibited the state from accepting federal money to implement the federal law or from moving to set up a health care exchange.

When Tom Woods called me last year to let me know he was writing the book Nullification. I immediately wanted to help get this movement in high gear. I called Trevor Lyman and we created the Nullification Activist Petition Centers called ‘We Refuse. We then decided to start an education tour and contacted TAC to see if they wanted to participate. Texas Rep. David Simpson Files Legislation to Penalize TSA Agents

Earlier this week, freshman Texas state Representative David Simpson (R-Longview) has filed two bills to try to counter the threat of the TSA in Texas airports. One bill would ban airport body scanner in Texas. The legislation already has 18 co-sponsors from both parties. The other bill would make sexual contact with airline passengers by TSA agents a state felony.

David Simpson was endorsed by the RLC last year. He also spoke at a RLC meeting in November.

The bill, HB 1938, makes it a civil penalty for anyone working in a locally owned airport to install or operate whole-body imaging equipment — “including a device that uses backscatter x-rays or millimeter waves, that creates a visual image of a person’s unclothed body and is intended to detect concealed objects.” The penalty is capped at $1,000 per day per violation…

Kentucky Nullifying EPA & FDA and Eliminating income taxes?

Nullification: Get the Federal Government off Kentucky Farms.

Kentucky’s Tea Party candidate for governor Phil Moffett calls on Governor Beshear to declare a right of nullification against unconstitutional power grabs from Washington DC. We need a “Kentucky revolution” against Federal regulations. Simply put, “Nullification of Federal agencies” means NO trespassing in Kentucky.

“Protecting Kentucky’s farmers, producers, and consumers from suffocating Federal regulations that kill jobs is imperative if we are to revive our economy,” Moffett said. “Soaring food prices make this a state of emergency. Kentuckians are more capable of taking care of themselves than far-off bureaucrats and it’s time to get the FDA, DEA and Dept. of Agriculture off our farms and defend Kentucky against this Federal choke-hold.”

In the Kentucky Resolutions of 1798, Thomas Jefferson was the first to introduce nullification in response to a Federal attack on the great state of Kentucky. Jefferson said, “Whensoever the general government assumes undelegated powers….a nullification of the act is the rightful remedy.” Kentucky must again nullify. In the tradition of Jefferson, Phil Moffett is here to carry the banner of liberty forward for Kentucky once again. With Moffett’s leadership we will say NO to the Federal government when it claims powers not granted to them in the Constitution.

“The Tea Party is up in arms. The Federal government is spending and regulating us to economic death. Even with a $1.5 trillion deficit on the table Washington has only proposed $61 billion in cuts. If Washington isn’t going to cut the spending, we’re going to have to stop Washington ourselves by eliminating redundant and unconstitutional Federal departments. For example, Kentucky has its own department of Agriculture, so there is no need to pay for an additional Federal agency to do the same job. Kentucky needs real leadership to stop the madness and as governor I intend to give the tea party platform real teeth,” said Moffett. “The Tea Party message to Washington D.C. is very clear – We don’t need the Federal government in our daily lives. We are free and capable people. We can take care of ourselves.”

Nullifying the Federal regulatory agencies off our farms will incentivize the multi-billion dollar organic and natural food industries to invest in Kentucky — a move that would bring more jobs and more choices to our state. One such crop currently blocked by the DEA is industrial hemp. Right now we are importing industrial hemp products into the U.S. from 31 western industrialized countries including Canada worth hundreds of millions of dollars in textiles, clothing, fabrics, oils, rope, pet products and many other goods. We are needlessly exporting jobs and dollars that could be in the pockets of Kentuckians.

Regardless of what the Federal government says about industrial hemp, We only need to look at the success of the Canadian industrial hemp industry. We must bring this untold million dollar industrial hemp industry (and others) to our state and stop the Federal government’s stranglehold on Kentucky’s economy.

Governor Perdue Vetoes The Health Care Freedom Act (NC House Bill 2)

On Saturday, NC Governor Beverly Perdue chose to veto The Health Care Freedom Act (NC House Bill 2). While her use of the executive veto is legitimate political action, in this instance it represents a wanton disregard for the wishes of a majority of our state’s legislators and citizens.

ObamaCare (HR 3590) prevents an individual from purchasing cost-effective health insurance tailored to his or her health status (section 2701) and requires them to obtain coverage for all risks regardless of personal exposure (section 1302). The “Value-Based Payment Modifier” (section 3007) allows a group of fifteen unelected bureaucrats to decide what medical care regimen is permissible for each patient based on cost-effectiveness and provides for fines and incarceration of physicians who don’t comply. The “Independent Payment Advisory Board” (section 3403) caps Medicare spending to a percentage of GDP at a time when the number of seniors covered by and entering the program is increasing.

In spite of assurances from the Obama administration, it is unlikely that you will be able to keep your current health insurance policy or your personal physician. As a 35-year medical professional whose first priority is to my patient, l find this completely unacceptable.”

The imposition of these and other regulations by this federal legislation constitutes a direct threat to the medical health and longevity of the citizens of North Carolina. The Health Care Freedom Act (HB2) veto, if overridden, will protect individual health care rights for the citizens of North Carolina. More specifically, the Health Care Freedom Act represents North Carolina’s 10th Amendment responsibility to its citizens to nullify federal legislation that reaches beyond the scope of its enumerated powers; Article 1, Section 8.

The Governor’s veto, coming on the heels of a meeting with President Obama and in contradiction to her previous position, does more to protect the dictates of her political party than the health care of North Carolinians. Furthermore, it violates the US Government’s Service Code of Ethics’ first principle: “Any person in government service should put loyalty to the highest moral principles and to country above loyalty to government persons, party, or department.”

Governor Perdue’s veto of The Health Care Freedom Act must be overridden. Please contact your representative in Raleigh and urge them to fight for North Carolina’s health care freedom. Three Senate Democrats with narrow 2010 victories are especially vulnerable and should be pressured to join the defense of our health care liberty:

Governor Candidate Phil Moffett: Nullification to Help Kentucky Farmers, Hemp Freedom

Skyrocketing food and fuel prices should be met by Kentucky nullifying federal prohibition of industrial hemp cultivation, Republican Tea Party gubernatorial candidate Phil Moffett said.

“We are out of time for continuing the confusion about what hemp is and what it could do for Kentucky’s economy,” Moffett said. “Hemp as both a food and fuel source could be a great blessing to Kentucky especially if recent trends continue or worsen. There is no good reason for allowing the federal government to stand in our way.”

Industrial hemp production is prohibited in the United States through Drug Enforcement Agency regulations. Industrial hemp is not a drug. As Phil has said many times on the campaign trail, hemp is as close to marijuana as poppy seeds on your hamburger bun are to heroin. The industrial uses for hemp include paper, housing products, automotive products, food and even diesel fuel. Hemp is grown legally in thirty countries and is imported to America for use here. But it is illegal to grow it here.

And that hurts Kentucky farmers.

Kentucky could grow industrial hemp in large enough quantities that it could be a good cash crop for our farmers and create multiple processing and retail opportunities that are prohibited now for no good reason.
